Impaired Value?

The capacity of CompuServe’s computers to process email in a reliable, timely way was at least part of their value to CompuServe. The court found that, by sending massive amounts of email, placed a significant burden on the computers’ processing capacity and deprived CompuServe of the use of that capacity.

Therefore,

(a) Cyber Promotions intentional unauthorized use impaired the value of the computers.

(b) Cyber Promotions intentional unauthorized use did not impair the value of the computers.
