The transaction is one in which a consumer enters a contract which they do not read and would not understand if they did read.
The court adds this to the characterization of the transactoin:
the “Bank reserved to itself the unilateral and nonnegotiable right to vary every aspect of the performance required by the parties to the account agreements.”
